Letter of Wishes to accompany a will

This can be used if the will is complex, to support the decisions you've made.

If you have a will that you’d like to make a minor change to, you may be able to do this with a codicil. A codicil is is a separate legal document, that amends the terms of your existing will.  We can’t do this digitally as we’d need you to share a copy of the original will and any existing codicils to that with us by post.

Please note that if you instruct a codicil, the wording and terms of your original will are amended, not removed. This means that the full terms and wording of your original will can still be viewed by the relevant parties upon you death.

This legal document gives powers to a person or persons you trust to manage your money and/or property on your behalf.

    Our power of attorney (POA) options include guidance and advice from a legal professional, certification of mental capacity, professional witnessing of the document(s), registration of POA with the Office of the Public Guardian (Scotland) on your behalf, and free secure storage of the documentation.

    A POA is only valid once it has been registered with the Office of the Public Guardian (Scotland). A fee per POA is payable to the OPG (fee not included in our pricing).

Welfare power of attorney

This legal document gives powers to a person or persons you trust to make decisions on health and personal welfare matters on your behalf, in the event that you lose capacity.

Living will

A statement of your wishes if, as a result of serious physical illness or mental incapacity, you’re unable to communicate or take part in decisions regarding yoru medical treatment and do not wish your life to be sustained by artificial means, limiting medical treatment to keeping you comfortable and free from pain.

This is similar to a power of attorney and only deals with specific instructions whilst you are alive.

If you'd prefer, you could complete the instruction form with one of our legal professionals over a phone call or have a copy sent to you to complete at home and return by post.  Brodies have offices in Glasgow, Edinburgh, Aberdeen and Inverness so if you live nearby, you could arrange to meet a legal professional in person.

Once you’re happy with their draft, they’ll send you the will and or power of attorney.

So we can witness your signature. You can then send it back to us if you’d like, so that we can keep the original document safe for you.

A power of attorney (POA) is only valid once it has been registered with the Office of the Public Guardian (Scotland). We do this on your behalf as part of our service, however you can choose to do this yourself if you'd prefer. A fee per POA is payable to the OPG (fee not included in our pricing).
